The Patrol Division is composed of sworn officers whose sole duty is to serve the
populace of the City of Chubbuck. Examples of this service include responding
to all calls for assistance, protecting people in need, enforcing law and order
within city limits, and performing community based services such as education of
youngsters.
|

Our officers are commited to providing the best service possible to the law
abiding citizens of this community and to eradicate the criminal element that is
a detriment to community health and prosperity. We welcome both your input

FREQUENTLY ASKED QUESTIONS
|
What if I see emergency lights or hear sirens?
|
Immediately slow down and safely pull your vehicle to the right hand curb or roadside. Under
Idaho State Code, you must do this or you will be cited. This is for the safety of all motorists and to allow emergency
response vehicles to assist those in need. This also applies for funeral escorts. We recommend that you do not wait
until you see what the police car is doing, but again, immediately pull to a stop to the right of your travel lane.

You are further required to give emergency vehicles that are stopped with their lights on a wide berth under
Idaho State Code. You are required to slow to below the posted speed limit and safely move over.

I locked my keys in my car, can you help me?

Where do I put my new registration sticker?
|
The proper placement is in the lower right hand corner of both your front and rear license plates. All previous year stickers should be removed and the plate
should be cleaned of dust and road grime. Ensure the sticker is not inverted. For example, do not place a 6 upside down or it
will look like a 9.

You will most likely get pulled over and may receive a ticket for improper display even if
your registration is current if you fail to follow these very simple rules. If you feel
that you need assistance, please stop at the Chubbuck Police Department and we will help you
apply your stickers.

License plate and registration sticker theft are becoming more common. If your license plates are stolen,
report the theft as soon as possible to our non-emergency phone number: (208) 237-7172. You can deter license plate thiefs
be using license plate holders that use bolts rather than screws to hold license plates in place. Also, you
can cut you registration sticker with a sharp razor AFTER you stick
it in place to make it harder to remove in one piece. You will be cited for fictious display and possession of
stolen property if you are pulled over with stolen plates or stickers.

I was told my case was civil, What does that mean?
Criminal law addresses the violation of a written law in which the State of Idaho
prosecutes an individual on behalf of the citizenry as a whole. Criminal law
violations generate the need to investigate crimes, prosecute defendants, and hold
offenders accountable, usually through penitentiary, jail or probationary sentences.
Civil law addresses personal or contractual disputes between individuals and/or
organizations. In most cases, civil disputes involve one person and/or organization
seeking compliance to a written or verbal agreement between themselves and a second
party.
A police officer is charged with enforcing criminal law, not interpreting civil
law or mediating contract disputes. Due to lack of training and expertise
in the area of civil law, this agency will not offer legal advice concerning civil
matters beyond suggesting that the parties involved contact legal counsel.

What are common examples of inattentive driving?
Eighty percent of motor vehicle crashes in the United States involve distracted drivers, according to a
government study that videotaped the drivers of 100 vehicles in northern Virginia and Washington D.C.
Researchers reviewed thousands of hours of video and data from sensor monitors linked to the drivers
and discovered that driver distractions such as talking on a cell phone, eating, and applying make-up,
can significantly increase the risk of a crash.
Of the popular multi-tasking activities drivers engage in while on the road, reaching for a moving object
while driving showed the greatest potential for a crash – increasing the risk by nine times. Reading, texting, applying
make-up, and dialing a cell phone each increased the risk of a car accident by about three times.
Inattentive driving is a misdemeanor
and you will be cited if officers see you involved in any activity that distracts you from operation of your vehicle.

Am I required to give an officer my information?
|
If you are in any way involved in an investigation into any suspected criminal activity and an officer asks you for
your personal information, you are required by law to give him or her that information.
Failure to comply with a lawful request for your personal information will most likely result in your arrest for
resiting and obstructing
a peace officer. It is very unfortunate the number of times people are arrested for basically failing to comply with
our simple requests for information.
Providing false or
misleading information to a peace officer in the course of an investigation is also an arrest offense. It is
recommended that you carry either you drivers license or state identification card with you at all times.
We attempt in every encounter we have with the public to conduct ourselves in a professional and courteous manner.
We also understand that you may have reason to protect your personal information. Ultimately, we are tasked with the
investigation and prosecution of criminal offenses and may have to gather personal information from you that you may feel
is in some way violating your privacy. Beligerant, obstructive or deceptive behavior on your part will only
temporarily hinder our investigation and will, in the end, most likely lead to your arrest and incarceration.

I am being harassed, what should I do now?
If you feel you are being harassed, the first thing you need to do is sever all communication between yourself and the person
whom you feel is harassing you. Do not answer phone calls or text messages from that person.
You then need to contact the Police and file a report. The Bannock County Prosecutors Office typically will not charge
a person with harassment unless a report has been filed, the person who is alledgedly the aggressor has been warned by a peace
officer to cease harassment and that person then continues the harassment pattern.
There are exceptions to this warning requirement such as when threats of physical injury are made or the harassment is in the
form of stalking.
Be prepared to show proof of harassment in the form of phone messages, text messages or other documentation. If, after a
warning has been given, you contact the person who is harassing you, it will most likely result in you also being cited for harassment.

What criteria makes a vehicle street legal?
|
I witnessed a crime, why do I have to sign the citation?
|
In order for an officer to issue a citation, he or she must have either witnessed the offense or have
proof beyond a reasonable doubt that the offense occured and that the person accused did in fact commit
the offense. If you are the only person who actually witnessed the offense, then we depend on you
to sign the citation and appear in court to testify as to what you witnessed.
For example, if you witness a person driving recklessly at high speed and notify us, we will make every
effort to respond as quickly as we can to catch the reckless driver in the act. However, if we arrive
and the driver is no longer violating the law, we cannot cite that person because we did not witness a violation.
If you are not willing to sign the citation either, then the reckless driver will not be charged.
Please do not let this deter you from calling us if you witness illegal activity, but understand that we are
limited in what we can do as far as enforcement if you are not willing to sign and testify.
