CRIMINAL INVESTIGATIONS DIVISION OVERVIEW
The Criminal Investigations Division handles serious crimes such as financial fraud, drug offenses, sexual assault, child abuse and physical assault.  It is our policy that all cases are referred to detectives after initial investigation by patrol officers.  Please forward all reports of criminal activity to dispatch and a patrol officer will be sent to assist you.
It is strongly recommended that all requests made by our detectives be met in a timely manner.  Failure to keep appointments or submit needed documentation can be very detrimental to an ongoing investigation and may result in an arrest warrant being issued.

What if I am the victim of financial fraud?
The Bannock County Prosecutor's Office has established a minimum amount for prosecution at $250. This agency investigates all eligible fraud cases with two goals - restitution for the victim and prosecution of the offender. A collection agency is your best recourse for lesser fraud cases.
If you are the victim of a fraud over the amount of $250, you will need to file a police report.  It is best that you come to the Chubbuck Police Department in person to file your report with a patrol officer.
You are required to provide the following information for a fraud investigation:
bullet  Original documents such as returned checks or charge receipts
bullet  A fraud victim's packet that will be provided to you when you file.
bullet  Any information that may help identify the suspect: video, description, etc...
After you have filed a police report with a patrol officer, the information you provided will be forwarded to the Criminal Investigations Division.  A detective will be assigned your case and may be in contact with you for more information.  A fraud investigation typically involves a fair amount of cooperation between the investigator and the victim.  Failure to respond promptly to requests or to complete necessary documentation will greatly hinder an investigation.
Can I report a crime that occurred in the past?
Trailer Yes.  The statute of limitations for most misdemeanor cases is one year and for most felony cases is five years.  However, elapsed time is detrimental to any investigation, so it is recommended that all crimes be reported as soon as possible.

Under Idaho State Code, cases that involve the physical or sexual assault of minors have no statute of limitations.  If you or someone you know were the victim of this type of crime, please notify the agency with jurisdiction over the location where the offense occured.  If you are uncertain as to what agency has jurisdiction, we will assist you in the process of getting a report filed.

I was told my case was civil, What does that mean?
Trailer Criminal law addresses the violation of a written law in which the State of Idaho prosecutes an individual on behalf of the citizenry as a whole.  Criminal law violations generate the need to investigate crimes, prosecute defendants, and hold offenders accountable, usually through penitentiary, jail or probationary sentences.

Civil law addresses personal or contractual disputes between individuals and/or organizations.  In most cases, civil disputes involve one person and/or organization seeking compliance to a written or verbal agreement between themselves and a second party. 

A police officer is charged with enforcing criminal law, not interpreting civil law or mediating contract disputes.  Due to lack of training and expertise in the area of civil law, this agency will not offer legal advice concerning civil matters beyond suggesting that the parties involved contact legal counsel.
